Terms of Service

1. Acceptance of Terms

By accessing or using Bushwick ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. Eligibility

You must be at least 18 years old to use Bushwick. By using the App, you represent and warrant that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into these Terms
  • You are not prohibited from using the App under applicable law
  • You have not been convicted of a felony or sex crime
  • You are not required to register as a sex offender

3. Account Registration

To use Bushwick, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Promptly update your information if it changes
  • Accept responsibility for all activity under your account
  • Not share your account with others

4. Subscription and Payments

Bushwick offers subscription plans that provide access to the App's features.

  • Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period
  • Payment is charged to your Apple ID account at confirmation of purchase
  • You can manage and cancel subscriptions in your App Store account settings
  • No refunds are provided for partial subscription periods
  • Prices may change with reasonable notice

5. Community Guidelines

You agree to treat other users with respect and follow our community guidelines. You will NOT:

  • Harass, bully, stalk, or intimidate other users
  • Post content that is hateful, discriminatory, or promotes violence
  • Share sexually explicit or pornographic content
  • Impersonate another person or misrepresent your identity
  • Use the App for commercial purposes or solicitation
  • Spam other users or send unsolicited messages
  • Share other users' information without consent
  • Use automated systems or bots

6. Content Standards

All content you upload (photos, bio, messages) must:

  • Be your own or you have the right to use
  • Not infringe any third party's intellectual property rights
  • Not contain nudity, sexually explicit material, or violence
  • Not promote illegal activities
  • Accurately represent yourself (recent photos, truthful information)

We use automated photo moderation to detect and remove prohibited content. We reserve the right to remove any content that violates these standards.

7. Safety

While we take measures to verify users and moderate content, we cannot guarantee the behavior of users. You are responsible for your own safety when meeting people from the App. We recommend:

  • Meeting in public places for first dates
  • Telling a friend where you're going
  • Not sharing personal financial information
  • Reporting suspicious behavior immediately

8. Intellectual Property

The App and its content (excluding user content) are owned by Bushwick and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.

By posting content on Bushwick, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the App.

9. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time through the App settings.

10. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:

  • That you will find a match or romantic partner
  • The accuracy of user profiles or information
  • The behavior, identity, or intentions of other users
  • Uninterrupted or error-free service

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUSHWICK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, EMOTIONAL DISTRESS, OR DAMAGES RESULTING FROM INTERACTIONS WITH OTHER USERS.

12. Governing Law

These Terms and your use of the App shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

13. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

You and Bushwick agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App shall be resolved through binding individual arbitration, rather than in court, except that either party may bring claims in small claims court if eligible.

Arbitration Rules

  • Arbitration will be administered by JAMS under its Streamlined Arbitration Rules
  • The arbitration will be conducted in English
  • The arbitrator's decision will be final and binding
  • Judgment on the arbitration award may be entered in any court of competent jurisdiction

Class Action Waiver

YOU AND BUSHWICK AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. Unless both you and Bushwick agree otherwise, the arbitrator may not consolidate more than one person's claims.

Opt-Out

You may opt out of this arbitration agreement by sending written notice to legal@bushwick.app within 30 days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration.

14. Copyright and DMCA

We respect the intellectual property rights of others. If you believe that your copyrighted work has been copied and is accessible on the App in a way that constitutes copyright infringement, please provide our copyright agent with the following information:

  • A physical or electronic signature of the copyright owner or authorized representative
  • Identification of the copyrighted work claimed to be infringed
  • Identification of the material that is claimed to be infringing, with enough detail so we can locate it
  • Your contact information (address, telephone number, email)
  • A statement that you have a good faith belief that use of the material is not authorized
  • A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on their behalf

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes through the App or by email. Continued use of the App after changes constitutes acceptance of the new Terms.
